Matthew Villani, a member of our litigation/trial team, obtained a verdict on behalf of a PMOH client after a Bench Trial in the Superior Court of New Jersey, Middlesex County. Mr. Villani’s client was operating her vehicle when an unidentified vehicle made a wide u-turn in front of her vehicle. The client attempted to avoid striking the unidentified vehicle, but in doing so struck three other vehicles and caused damage to a commercial building.
Mr. Villani successfully argued that his client was faced with a sudden and imminent emergency, not caused by her own tortious conduct and thus, should not be found negligent for causing the accident.
