PMOH Partner, Rita Barone,Obtains No Cause from Jury on Bodily Injury Action Tried in Middlesex County Superior Court
On September 16, 2011, Rita Barone obtained a judgment for a PMOH client in a hotly contested automobile accident case in which the plaintiff claimed he was entitled to compensatory and punitive damages. After a three day trial, the jury determined that the plaintiff had not sustained a permanent injury that was proximately caused by the accident. Prior to trial, the judge granted Ms. Barone's motion to bifurcate the trial so that the plaintiff's factual contentions on the punitive damages claim would not be presented to the jury.
