PMOH Partner, Susan Lawless, Obtains No Cause from Jury on Bodily Injury Action Tried in Middlesex County Superior Court   

On September 27, 2011, Susan Lawless obtained a judgment for a PMOH client in an automobile accident case in which both the plaintiff’s and the defendant’s medical expert’s agreed that an MRI performed on a date after the accident showed a tear in the plaintiff’s rotator cuff.  Plaintiff claimed that the tear was traumatic in nature, caused by the accident and, therefore, she was entitled to compensatory damages.  At the conclusion of the defendant’s case, the judge granted plaintiff’s motion for a directed verdict on the issue of liability for the happening of the accident.  After a three day trial, the jury determined that the plaintiff had not sustained a permanent injury that was proximately caused by the accident.
